• ANNEX 1 - MANDATORY CONDITIONS

   

  Supply of Alcohol

   

  1.              No supply of alcohol may be made under the premises licence;

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  3.               (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

   

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

   

  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

   

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  4.               The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  5.              (1)  The premises licence holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

   

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

   

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

   

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

  6.  The responsible person must ensure that-

   

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

   

  (i) beer or cider: ½ pint;

  (ii)gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii)still wine in a glass: 125 ml;

   

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

   

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  7. Prohibition on Sale of Alcohol below Cost of Duty plus VAT             

   

  (1)              A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

  (2)              For the purposes of the condition set out in paragraph (1) -

               

  (a)              “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  (b)              “permitted price” is the price found by applying the formula -

                   

  P = D + (D x V)

     

                                 Where -

   

  (i) P is the permitted price,

  (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol

   

  (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence -

   

  (i) the holder of the premises licence,

  (ii) the designated premises supervisor (if any) in respect of such a licence,

  or

  (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;

   

  (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

               

  (e) “valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994

   

  (3)              Where the permitted price given by Paragraph (b) of paragraph (2) would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

   

  (4)              (a) Sub-paragraph (b) below applies where the permitted price given by Paragraph (b) of paragraph (2) on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

   

  (b) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

  Exhibition of Films

   

  1.              Admission of children to the exhibition of any film is to be restricted in accordance with the recommendations made by the specified film classification body.

   

  2.              Where -

  (a)              the film classification body is not specified in the licence, or

  (b)              the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,

   

  admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  3.              In this section -

  “children” means persons aged under 18; and

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

   

  Door supervision.

   

  1.              Any person(s) required to be on the premises to carry out a security activity must be authorised to carry out that activity by a licence granted under the Private Security Industry Act 2001 or be entitled to carry out that activity by virtue of Section 4 of that Act.

  ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1.                                          Maintain the existing CCTV system.

  2.              Maintain noise attenuation measures.

  3.              No external drinking after 23.00 hours.

  4.              There will be no external regulated entertainment.

  5.                                          All windows and external doors to be shut during live performance save for customer access and egress.

  6.              No children to be allowed on site after 21.00 hours.

  7.       Between 08.00 hours and 11.00hours each day alcohol will only be sold or supplied to persons who are eating breakfast/hot food in the premises.

  8.      CCTV shall be provided in the form of a recordable system capable of providing clear quality

           images of evidential quality in all lighting conditions CCTV shall be provided in the form of a

           conditions.

  9.       Cameras shall encompass all entrances and exits to the premises, any outside

            smoking/seating areas, all areas where the sale/supply and consumption of alcohol occurs

            within the premises and the public areas of all the

            toilet facilities in the premises (with the exception of the disabled toilet facilities, access to

            which is controlled by staff on request.)  Equipment shall be maintained in good working

            order and correctly timed and dated.

            Recordings will be available for a period of 31 days and handed to any authorised officer on

            request, in accordance with Data Protection Legislation.  The recording equipment being of a

            digital hard drive system that shall be kept in a secure environment under the control of the

            Premises Licence Holder or other responsible named individual.  The CCTV system must be

            checked by a qualified CCTV engineer on an annual basis.

  10.    Signage representative of the above must be displayed in conspicuous positions, within the

           premises including the toilet area.

  11.   There shall be sufficient members of staff trained to be able to view/download images with the

          minimum of delay at the request of any authorised officer.

  12.    No open vessels, glasses, bottles or alcohol containers will be allowed to be taken off the

           premise (with the exception of any outside seating area).

  13.    On all Fridays, Saturdays and Sundays pre-ceding Bank Holiday Mondays all alcohol for

          consumption in the rear outside seating area shall be dispensed in to Plastic/Polycarbonate

          drinking vessels after the 22.00 hours.

  14.    The Premises Licence Holder/Designated Premises Supervisor shall implement a written 

           drugs policy, this shall include strategies to minimise the use and supply of illegal drugs

           within the Premises.   The drugs policy shall inclusde a structured training policy for all staff

           covering the issues of misuse of drugs in relation to licensed premises.  Hourly toilet checks

           are to be made and recorded.  Appropriate signage in relation to the drugs policy shall be

           displayed.  Staff will inform police immediately of any suspicious activity within, or in the

           vicinity of, the premises.

  15.    Any evidence of drug use will be recorded in the incident  register/log at the premises.  Any

          incidents of note will be reported to Merseyside Police.

  16.   An incident log book shall be kept on the premises and made available on reasonable request

         to the Police which will record, any incidents of crime /disorder, any seizures of drugs or

         offensive weapons and any ejections of customers.

  17.   A minimum of four SIA Registered Door Supervisors to be on duty on all Friday and Saturday

         evenings and all Sundays preceding Bank Holiday Mondays from 2100 hours until the

         premises close.  The requirement for additional SIA regsitered Door Supervisors will be risk

         assessed by the Designated Premises Supervisor/Premises Licence Holder to determine

         (cognisant of Police Advice)  when it is appropriate for the minimum number of SIA registered

         Door Supervisors to be above four.

  18.   When SIA Door Supervisors are employed at the premises a register of all door supervisors will

          be kept at the premises  with recorded details of dates and times on duty, full names and 16

          digit SIA numbers, signed on and off duty by the DPS or deputy.   All incidents involving door

          supervisors will be recorded in the door superviors register.

  19.   When on duty SIA registered Door Supervisors must use Metal Detecting Wands on all

          entrances to the premises.

  20.   When on duty the SIA Registered Door Supervisors must be easily identifiable and must be in

         security company uniform at all times.  All SIA registered Door Supervisors will have personal

         radio communication with earpieces.

  21.  A separate book shall be kept in a secure office which shall contain the full name, address,

        date of birth, 16 digit SIA badge number and photograpgh of all SIA door staff who work at the

         premises.  These details shall be made available to any authorised officer on request and in

         accordance with Data Protection legislation.

  22.  All staff employed at the premises will have undertaken a form of Crime Scene Management

        Training details of which  will be made available to any authorised officer on reasonable request.

  23.  The premises will operate Challenge 25 policy in that persons who appear to be under 25

        years of age are challenged to prove, by way of acceptable form of ID (photo driving licence,

        Passport, a PASS accredited proof of age card or military ID) that they are 18 years of age or

        older.

  24. All staff responsible for alcohol sales must be trained in respect of their responsbilities under the

       Licensing Act 2003 and in particular sales of alcohol to persons who are drunk or underage

       before they engage in the sale of alcohol.  Refresher trianing shall be undertaken at least every 6

       months.  Records of training shall be retained for at least 12 months.

  25. All the refusals for the sale of alcohol will be recorded and records kept for inspection by any

       authorised officer on reasonable request.

  ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  Added at Hearing dated 13.08.19

   

  1.  Implementation of a noise management plan at the premises.

   

  2.  The garden bar will be permanently supervised and is not to be used beyond 22.00.

   

  3.  When the bar is not in operation, all alcohol will be secured to prevent customer access.

   

  4.  A minimum of two staff will be working when the garden bar is in operation.

   

  5.  Bottle bins shall not be emptied outside between the hours of 19.00 and 09.00
