Annex 1 - Mandatory Conditions
Supply of Alcohol
1. No supply of alcohol may be made under the premises licence;
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
4. The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
5. (1) The premises licence holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-
(a) a holographic mark, or
(b) an ultraviolet feature.
6. The responsible person must ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii)gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii)still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.
7. Prohibition on Sale of Alcohol below Cost of Duty plus VAT
(1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
(2) For the purposes of the condition set out in paragraph (1) -
(a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;
(b) “permitted price” is the price found by applying the formula -
P = D + (D x V)
Where -
(i) P is the permitted price,
(ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol
(c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence -
(i) the holder of the premises licence,
(ii) the designated premises supervisor (if any) in respect of such a licence,
or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) “valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994
(3) Where the permitted price given by Paragraph (b) of paragraph (2) would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
(4) (a) Sub-paragraph (b) below applies where the permitted price given by Paragraph (b) of paragraph (2) on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.
(b) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
Exhibition of Films
1. Admission of children to the exhibition of any film is to be restricted in accordance with the recommendations made by the specified film classification body.
2. Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
3. In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).
Door Supervision
1. Any person(s) required to be on the premises to carry out a security activity must be authorised to carry out that activity by a licence granted under the Private Security Industry Act 2001 or be entitled to carry out that activity by virtue of Section 4 of that Act.
Annex 2 - Conditions consistent with the Operating Schedule
1. Live music may be played at the Festathlon Event between midday and 11pm
The maximum permitted time of the application will be for 3 days on 2
occasions per year. Live music will be played between, alongside and
potentially after sporting activity is completed. All live and recorded music will
finish by 23:00
2. The licence shall have effect for up to 3 days only, being on a Friday to a
Sunday inclusive, on up to two occasions only each calendar year between 1st
April and 30th September on dates to be notified to the Licensing Authority and
Police at least 2 calendar months before the Event is scheduled to take place
each year (or on such other date or dates as may be agreed in writing by the
Licensing Authority should unforeseen circumstances require the date of the
Event to be changed at short notice) and only in respect of an event organised
by the Event Organiser.
3. No more than 4,999 persons, including all members of the public attending the
Event, staff, performers, contractors and any other person shall be permitted in
the Licensed Area at any one time.
4. An overall Event Safety Plan which shall include the designation of named
individuals as being responsible for overall safety at the event and a deputy, the
Designated Premises Supervisor and at least one other personal licence holder
to be present on site during the event and the Head of Security.
5. A Security and Stewarding Plan which will set out the numbers of SIA registered
staff and non SIA registered stewards working at the event throughout the event,
their deployment and duties.
6. All security and stewarding staff will wear high visibility vests or tabards clearly
identifying them as security or stewarding staff as appropriate whenever they are
on duty at the event site or surrounding areas, save that staff working in
or at the entrances to the VIP hospitality areas (where admission is restricted to
persons holding tickets permitting access to those areas) shall only be required
to wear their SIA badges and need not wear hi visibility vests or tabards.
7. The Security and Stewarding Plan will also include a Crowd Safety Plan and
Emergency and Evacuation Plan and shall provide for the marshalling of
persons leaving the event site on foot after 22:00 hours.
8. A Traffic Management Plan which will address issues relating to the movement
of vehicles used by persons attending the event (including contractors and others
involved in setting up the event), the provision of transport for persons
attending the event, the monitoring and enforcement of parking regulations,
whether permanent or temporary
9. A Noise Management Plan which will address issues relating to the prevention of
public nuisance from noise relating to the provision of regulated entertainment
during the event.
10. A Ticketing Policy which shall include conditions of entry to the effect that ticket
holders agree that:
- No alcohol is to be taken into or out of any area where licensable activities are
taking place;
- Consent to being searched on entry to the Event Site and/or the Licensed Area
and whilst on the Event Site;
- Wristbands provided by the Event Organiser at all times;
- that any breach will result in the expulsion of the person concerned from the
Event Site.
15. A Medical Plan to deal with any persons who may suffer an injury or illness
during the event, to include details of onsite medical teams.
16. A Child Welfare Policy which will deal with methods of minding “found” children
or searching for “lost/missing” children, ensuring persons under the age of 18 do
not have access to alcohol.
17. A copy of the final EMP shall be provided to the Licensing Authority and all
relevant members of the SAG at least 28 days before the event is scheduled to
take place each year but nothing herein shall prevent further
modifications to the EMP at a later date, including whilst the event is taking
place, provided notification of any change is given to the relevant members of
the SAG.
18. The event organiser shall also ensure that facilities are made available for all
relevant SAG members to meet with representatives of the event organiser at
least once each day of the event to review the Event Management
and Security Plans and to amend the same if considered necessary.
19. Notwithstanding the plan annexed to the Licence, the event organiser shall
provide the Licensing Authority and the SAG with a detailed site plan (“the site
plan”) at least 28 days before the event each year showing (inter alia)
the car parks, hospitality tents and other structures used for the sale of alcohol
or the provision of regulated entertainment, public entrances, emergency
access and egress points and emergency routes within the Event Site and
lavatory facilities
20. The area to be used for licensable activities shall be limited to the Licensed
Area or, if part only of the Licensed Area is to be used, the extent of that area
shall be shown on the site plan. The area shall be surrounded by a fence
(save for access and egress points, including emergency exits). All access and
egress points shall be monitored by SIA registered security staff at all times that
licensable activities are taking place within the area. Security staff will be
instructed to carry out random searches on persons entering or leaving the area
and to record any occasion where substances suspected of being illegal drugs
or offensive weapons are found and to report any such seizures to the Police as
soon as reasonably possible.
21. The Event Organiser shall adopt a “zero tolerance” policy towards the
possession and use of illegal drugs. Any person found to be in possession of
any substance suspected of being an illegal drug anywhere on the event site
shall be required to leave. This policy shall be advertised on the Event’s website
and by notices displayed at public entry points to the Event Site.
22. The Event Organiser shall ensure that throughout the Event each bar or other
outlet selling alcohol is overseen by a named individual who is the holder of a
personal licence. There will be a minimum of 2 such individuals. The name of
each individual and the bar or bars for which they are responsible will be
provided to the Licensing Authority and the Police at least 7 days before the
Event. Further, a notice will be displayed in each bar or other outlet selling
alcohol identifying the person responsible for overseeing that outlet. For the
avoidance of doubt, nothing herein will require the individual person responsible
to be physically present at all times alcohol is being sold.
23. All staff involved in the sale of alcohol shall be instructed in the relevant licensing
laws - i.e. that they must not serve alcohol to people who are drunk or to persons
under 18 or where it is suspected that a person is attempting to buy alcohol
for a person under 18. To facilitate enforcement of this, the event organisers
shall adopt a “Challenge 25” policy whereby any person appearing to be under
the age of 25 (or attempting to buy alcohol for someone who appears to be
under 25) shall be required to provide proof of age (or proof of age for the
person for whom alcohol is being bought) in accordance with the mandatory
condition, even if the person or persons concerned are wearing “adult”
wristbands.
24. Notices advertising the policy shall be prominently displayed at all places where
alcohol is being sold. All persons under the age of 18 will be provided with a
wristband that is easily distinguishable from wristbands provided to all adults.
25. Ticket holders shall not be permitted to bring alcohol into or out of any area
used for licensable activities nor beyond the main pedestrian access gate from
the car parks, marked “A” on the plan.
26. The event organiser shall also ensure that notices are displayed at the main
entrance points into the car parks and at exits onto the public highway,
reminding drivers that it is illegal to drink and drive and security staff patrolling
car parks shall be instructed to give any person whom they suspect to be drink
driving (or about to drive whist drunk) words of advice to the effect that they
should not drive.
27. No beer, lager or cider shall be sold or otherwise supplied in any glass drinking
vessel and any glass bottled beer, lager or cider shall be decanted into a non-
glass drinking vessel before being handed to customers.
28. The Event Organiser shall ensure that incident logs are maintained by the
security companies providing SIA registered security staff and that detailed
records are made in that log (or one of them) of any incident that takes place
involving the commission of a criminal offence, particularly but not limited to
offences involving violence. Records shall also be kept of all occasions where a
person refuses to be searched or a search reveals a prohibited substance or
object and or any occasion or event leading to the removal of a person from the
Event Site. The log shall identify the person or persons dealing with the incident
and, whenever possible, details of any witnesses and an account of what
occurred. The logs shall be made available for inspection by the Police and
Licensing Authority throughout the event and shall then be retained by the Event
Organiser for a minimum period of 6 months following the event or for longer, if
required for evidential purposes.
29. At each outlet selling alcohol either a till system shall be used to record all
instances where the sale of alcohol is refused or, if the till system is not capable
of recording such information, a manual record shall be maintained noting the
name of the staff member refusing the sale, the date and time and reason for
refusal. The records shall be retained for a minimum period of 6 months and
made available for inspection by police and other authorised officers on
request.
30. The number of persons entering and leaving the Event Site shall be monitored
by Security staff and a record made at least every 60 minutes of the numbers
entering and departing. These records shall be made available for inspection
by the Police and Licensing Authority throughout the event and shall then be
retained by the Event Organiser for a minimum period of 6 months following the
event.
31. The Event Organiser shall ensure that ultimate control of all amplified music
levels shall rest with it and that noise levels are controlled throughout the event.
32. The event organiser shall ensure that there is a dedicated telephone number
which will be made known to the Licensing Authority before the event begins on
which local residents can report any issue regarding noise from the event. The
event organiser shall respond to any noise complaint by investigating the same
and, if the complaint is or may be justified, shall ensure that noise levels are
reduced so as not to cause a public nuisance.
33. In the event of noise complaints being received and this being witnessed and
substantiated by officers. A noise limiter would be fitted to the sound equipment
under the supervision of Environmental Health to avoid future noise nuisance to
local residents.
