ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. SIA registered door staff shall be employed at the premises, if required in accordance with a
risk assessment, to be carried out by the DPS and take cognizance of Merseyside Police.
When employed, door staff will wear high visibility armbands.
2. CCTV
Minimum of one high-resolution camera fitted for external coverage of entrances.
Minimum of one high-resolution camera shall be fitted to cover each public entrance/exit. Door
entrance cameras must be capable of providing good quality head and shoulder images of
persons entering/leaving the premises.
There must be sufficient cameras able to cope with the normal operating illumination, located
within the premises to cover public areas.
Lighting in the foyer and outside must be sufficient brightness to complement the quality of the
camera images.
In addition to the control equipment an additional high-resolution, minimum 15" monitor must be
sited in or near the serving area or foyer entrance. This will give installation and quality of
images provided.
All equipment shall have constant time/date generation, which, must be checked, for accuracy
on a daily basis.
The unit shall have an on board CD/DVD re-writer, for evidence recovery. (pen drive facility is
an alternative option)
The system must be capable of downloading/copying all the stored CCTV footage to another
medium in its native format. i.e. an external hard drive that can be played back via a
windows based computer.
Proprietors must contact the Data Commissioner to register the CCTV system under the Data
Protection Act if the cameras move and are capable or recording different public locations.
Static cameras that are used for general observations do not need to be registered. The Data
Commissioner can be contacted on Helpline 01625 545740.
There shall be sufficient members of trained staff available during the hours of operation to be
able to download evidence if the police or an authorised officer makes a formal request. Any
recordings taken by the police must be signed for with the name and station of the officer
concerned.
CCTV warning signs shall be fitted in public areas and at the entrance to the premises. This will
need to be minimum A4 size.
The CCTV system must be regularly maintained and checked for compliance every 12 months.
Recordings must be kept for a minimum of 31 days. This period may be reduced for premises
that have a large number of cameras, long recording times with high-resolution recordings that
will make it impossible for the premises to adhere to the 31 days. Police Licensing Section
must be consulted in these circumstances.
Unauthorised persons should not be allowed access to the system or allowed to view personal
data as it could contravene the data and compromise any criminal premises must be
Protected and made secure to prevent any unlawful viewing or disclosure.
The Designated Premises Supervisor or Premises Licence Holder must be able to
demonstrate that they have devised a recording management system that prevents recordings
being tempered with, stolen and misplaced or failure to record. Recording equipment shall
be housed in a secure room/cabinet where access and operation is strictly limited to
authorised persons.
In the event of a system malfunction, the Designated Premises Supervisor or Premises
Licence Holder must immediately notify the Licensing Authority 0151225 3478 and Police
Licensing Department 0151 7774830 . Details of this malfunction must be recorded in the
premises incident book. Arrangments for its repair must be made without delay.
2. Doors and windows in public areas will be kept closed as a matter of course except for access
and egress during the playing of amplified music.
3. The used bottle storage area for the hotel will be in the basement and will not be moved to
public highway level until shortly prior to the scheduled times for collection.
4. In so far as this consent relates to the ground floor restaurant/bar area the premises shall not be
open for business for non-resident hotel guests outside the hours of 08.00 and 02.00.
5. Noise control measures shall be employed within the development such that sound
generated within the commercial entertainment areas does not give rise to noise levels
exceeding NR30 in any nearby residential accommodation (expressed in terms of the
maximum sound pressure level in each octave band) as determined by the Councils
Environmental Health Service.
6. In so far as this permission relates to the ground floor restaurant/bar area, all windows and
doors into the premises shall remain in the closed position after 23.00 hours other than use of
doors for access to and from the premise.
7. Knockback or equivalent Challenge 21 proof of age scheme shall be in place with all relevant
staff to be trained prior to serving and age restricted products with refresher training every 6
months, records to be kept for inspection by Responsible Authorities.
8. Refusals system in place (til prompt or book) to be monitored by Designated Premises
Supervisor or nominated representative and made available to relevant Responsible
Authorities on request.
